By CONFIRMING your ride or activity at Ranch Siesta Los Rubios and entering the premises and grounds you are agreeing in full to our terms.
IMPORTANT NOTICE
YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF YOUR RIDING OR USE OF THE OWNER’S HORSE AND/OR PARTICIPATION IN EQUINE ACTIVITIES AT RANCH SIESTA LOS RUBIOS
INCLUDING INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF THE NEGLIGENCE OF YOU OR CAROLINE GRAHM.
READ THIS AGREEMENT CAREFULLY – YOUR BOOKING AND PARTICIPATION AT THE RANCH INDICATES YOUR UNDERSTANDING OF AND AGREEMENT TO ITS TERMS.
By being on site and taking part in an activity or spectating or visiting the premises and grounds of Ranch Siesta Los Rubios you hereby acknowledge on behalf of yourself that you have familiarized myself with the activities that you will be allowed to participate in, and that you do hereby acknowledge and agree that you will participate in these activities without restriction or limitation
You recognize the inherent risks involved in riding, being around and working with horses and a working stables environment, including but not limited to:
- Bites, kicks, treading on your feet, abrasions or contusions from horses.
- Being thrown or bucked off by horses or falling off yourself at any point.
- Dangers from passing cars, traffic, bikes, road users, animals etc.
- Slips and falls or stumbles resulting in your injury or falling off.
- Scratches or other injury from stalls or enclosures, gates, other horses, electric fences, dogs, buildings, tools and equipment.
- Scratches or other injury from grooming tools and other equine equipment and tack.
- Allergic reactions to animals, hay, or other allergens.
- Tripping in holes or on materials or equipment.
- Slipping, falling, or otherwise being injured in the barn, in stalls, or on the grounds, which can be slippery, muddy, wet, or contain or present other hazards.
You hereby specifically forever waive and release Caroline Grahm and Ranch Siesta Los Rubios, and its principals and agents and self employed instructors or advisors from any liability for injury arising out of the inherent risks from riding, working or participating in a stable environment and/or with horses, as well as from the active negligence of Caroline Grahm, its principals and agents.
By entering the premises and being on site or participating in a horse related activity or learning activity on the grounds or in the countryside and roads in the vicinity and Estepona, you hereby acknowledge that although there may be supervision during your time spent at Ranch Siesta Los Rubios, there will not be a nurse on the premises and Ranch Siesta Los Rubios and its principals and agents bear no responsibility for your health or medical care.
You agree to indemnify, save and hold harmless Ranch Siesta Los Rubios and its principals and agents from and against any loss, liability, damage, attorneys’ fees, or costs that they may incur arising out of or in any way connected with either my presence or participation at or any acts or omissions of Ranch Siesta Los Rubios principals or agents.
By booking your activity or entering onto the premises at any time you acknowledge your complete understanding, agreement and consent to your presence and/or participation in the activities at Ranch Siesta Los Rubios without restriction, without liability to Ranch Siesta Los Rubios, its principals or agents, and with full knowledge and understanding of the disclosures, waivers, and releases herein.
If you are present at and participate in the activities of Ranch Siesta Los Rubios you do so at your own risk, and you hereby acknowledge and agree that Ranch Siesta Los Rubios and/or any of its principals and agents shall bear no responsibility or risk associated with injuries that could arise from your presence or participation.
